1. Data controller

SHbyJM Europe SNC (Esc’Appart), Rue du Village 25D, 5542 Blaimont, Belgium, company number BE 0646.742.649.

This policy covers the escappart.com website and the “My stay” guest area (checkin.escappart.com).

For any question about your data: info@escappart.com.

2. Data collected

Estimate request. Area and municipality of the property, number of bedrooms and beds, condition of the property, name, phone, email, link to the current listing (optional), preference to be called and preferred time. Added to this are the language and the page of the form, the campaign parameters present in the page address, the browser type and a fingerprint of your IP address: we do not keep the IP address itself.

Contact message. Name, email, phone (optional), subject, message, consent to be called back by phone, and language.

Booking made on a platform (Booking.com, Airbnb, Expedia…). The details the platform sends us: name, email, phone, address, company and VAT number where applicable, country and language.

Booking made on this website. Your contact details, your stay, the offer chosen and the consent you give for the charge (date, time and version of the text accepted).

“My stay” area. Your billing details (name, email, phone, postal address, country, company and VAT number where applicable), the optional information about your stay (make-up of the group, pet, expected arrival time), any consent you give to receive our offers, and your invoice requests.

Traveller register (rentals in Belgium). For each adult traveller, and each unaccompanied minor over 15: surname, first name, place and date of birth, nationality and identity document number. For an accompanied minor: surname and first name. We never ask for a photo or a copy of the document.

Individual police form (rentals in France). Foreign travellers fill in an individual police form, as provided for by articles R. 814-1 to R. 814-3 of the French Code on the entry and residence of foreigners and the right of asylum (CESEDA).

Browsing. The cookies described in our cookie policy.

3. Purposes and legal bases

  • Preparing the estimate requested or replying to your message: pre-contractual measures taken at your request. For the estimate, you also give your consent by ticking the box in the form.
  • Managing your booking and your stay (payment, access to the rental, contact): performance of the contract.
  • Keeping the traveller register (Belgium): legal obligation (Belgian law of 1 March 2007).
  • Having the individual police form filled in (France): legal obligation (CESEDA, articles R. 814-1 to R. 814-3).
  • Issuing an invoice: legal obligation.
  • Sending you our offers: your consent, given through a box that is never pre-ticked and can be withdrawn at any time.
  • Measuring the website’s audience and our advertising: your consent, given in the cookie banner.
  • Protecting our forms against abuse (limited number of submissions per connection, trap field against bots): our legitimate interest.

4. Recipients

Your data is processed by the Esc’Appart team. It is never sold. Depending on the case, it is also passed on to:

  • PlanetHoster, which hosts the website and its database, on servers located in France;
  • Beds24, our booking manager, which connects our rentals to the platforms;
  • the platform through which you booked;
  • Stripe, our payment provider, which processes the payment of a booking made on this website on our behalf (as a processor);
  • the SHbyJM Hub, our request tracking tool, which receives a copy of estimate requests and of messages sent with the subject “I am an owner”;
  • Google (Google Analytics), only if you accept audience measurement;
  • Meta, only if you accept advertising: when you request an estimate or contact us as an owner, we report this request to Meta. Your email and phone number are sent in fingerprint form (hashing), never in plain text, together with the Meta cookie identifiers, your IP address, your browser and the page address;
  • the police, at their request, for the traveller register (Belgium) or the individual police form (France).

Some of these providers may process data outside the European Economic Area. In that case, we rely on the safeguards provided for by the regulations.

5. Payment

Your card is entered in a field provided by Stripe, our payment provider. Esc’Appart never sees or stores your card number: we only keep the identifiers that Stripe gives us.

When you book, we also keep a record of the consent you give for the charge: its date, its time and the version of the text accepted.

6. Retention periods

  • Guest contact details: erased 12 months after departure. After that, we only keep the country and language, which do not identify you, for our statistics. The booking itself (dates, rental, amounts) is kept for our accounts.
  • Billing details, stay information, consent to our offers and “My stay” link: deleted 12 months after departure.
  • Traveller register (Belgium): 7 years after departure, as required by law, then destroyed.
  • Individual police form (France): 6 months.
  • Card saved with Stripe: 30 days after departure, unless a claim is in progress.
  • Emails sent by the website: the copy kept in our sending queue is erased 30 days after sending (90 days if sending failed).
  • Estimate requests and contact messages, at Esc’Appart and in the copy held in the SHbyJM Hub: 3 years after the last contact, if there was no follow-up. You can ask for them to be deleted at any time.
  • Cookie choices: 396 days.

The erasure of guest contact details, “My stay” data and the traveller register is recorded in a log.

7. Your rights

You can ask for access to your data, its rectification or erasure, the restriction of its processing or its portability, and you can object to certain processing. When processing is based on your consent, you can withdraw it at any time.

Data in the traveller register and the individual police form cannot be erased before the end of its legal retention period.

To exercise your rights, write to us at info@escappart.com.

If you believe your rights are not being respected, you can lodge a complaint with the Autorité de protection des données (APD, Data Protection Authority), the Belgian supervisory authority.
