General terms of sale for guests

Only the French version is legally binding.

  1. Scope
  2. Price
  3. Two offers
  4. Booking and payment
  5. Cancellation
  6. Failed payment
  7. Arrival and “My stay”
  8. Deposit
  9. Extending the stay
  10. Invoice
  11. Right of withdrawal
  12. Personal data

1. Scope

These terms apply to stays booked directly on escappart.com. The seller is Esc’Appart, trading name of SHbyJM Europe SNC (see our legal notice), which invoices you for the stay.

For any question: info@escappart.com or +32 471 52 74 44.

2. Price

The price includes the nights and the stay fees (cleaning, linen, electricity).

A promotion can reduce the price of the nights, never the fees. Only one promotion applies at a time: the one that is best for you. It is valid for both offers.

The total price, including all taxes, is shown on the summary, before payment. This is the amount that is charged.

3. Two offers

Flexible. Your card is saved, nothing is charged when you book. The stay is charged 2 days before free cancellation ends, at 8 am (that is, 3 days before arrival), or straight away if that date has already passed.

Non-refundable. Cheaper than the flexible offer: the difference is shown for each rental at the time of booking. The stay is charged when you book.

4. Booking and payment

Before paying, you tick a box that states when and how much will be charged, and that an amount may be charged in the event of damage. It is never pre-ticked.

Your card is entered with Stripe, our payment provider. Esc’Appart never stores its number.

The booking is confirmed when your card is saved (flexible offer) or when your payment is accepted (non-refundable offer).

If your bank asks for authentication at the time of the charge, payment is made in your “My stay” area.

5. Cancellation

Flexible: free cancellation up to 24 hours before check-in time. If the stay has already been charged, it is refunded to you. You cancel from your “My stay” area. The check-in time is the one stated for the rental, or 4 pm if none is stated. After this deadline, or if you do not turn up, the nights remain due and the stay fees (cleaning, linen, electricity) are refunded to you; cancellation is then done by contacting Esc’Appart.

Non-refundable: no cancellation. If you cancel or do not turn up, the nights remain due; the stay fees (cleaning, linen, electricity) are refunded to you.

6. Failed payment

If the charge fails, you are notified by email, with a link to change your card. The charge is attempted three times on the same day: at 8 am, 11 am and 2 pm. You can pay in your “My stay” area until free cancellation ends. Without payment by then, the booking is cancelled automatically, free of charge, and you are informed by email. If part of the stay has already been paid, Esc’Appart contacts you.

Until the stay is paid, the access codes to the rental are not provided.

7. Arrival and “My stay”

Your “My stay” area (checkin.escappart.com) brings together the information about your stay.

For a rental located in Belgium, Belgian law requires a traveller register to be kept: before arrival, you declare the travellers there. For a rental located in France, foreign travellers fill in an individual police form (CESEDA, articles R. 814-1 to R. 814-3). The access codes are displayed once this declaration has been made and the stay paid, from the day of arrival until the day of departure.

8. Deposit

Nothing is held on your card. If damage is found, we notify you by email, with the details. You have 72 hours to reply (this period may be shortened if necessary, so that everything ends 24 hours before the deadline). Its amount may then be charged to your card, at the latest 7 days after departure.

Your card remains saved with Stripe until 30 days after departure, and longer only if a claim is in progress.

9. Extending the stay

From “My stay”, you can extend your stay up until check-out time, if the rental is available. The added nights start on your planned departure day. They do not include the fixed per-stay fees (cleaning, linen); the per-night fees remain due.

10. Invoice

You can request an invoice from “My stay”, after entering your billing details there.

11. Right of withdrawal

The right of withdrawal does not apply to accommodation provided on a specific date (Directive 2011/83/EU, Article 16(l)).

12. Personal data

The processing of your data is described in our privacy policy.
